Tekemu.com, Supremo Maths KS1 /Supremo Math / Supremo Maths are wholly owned and managed by Tekemu Limited.

     1. Introduction

Please review these Terms and Conditions (the "Terms") prior to using our products and services. By using any product or service provided by Tekemu Limited (“Tekemu”, “we”, “us”, “our”) you agree to the Terms set out in this document. 

These Terms incorporate and refer to our Privacy Policy which should also be reviewed prior to using any product or service by us.

Supremo Maths KS1 /Supremo Math / Supremo Maths (the “App”) is an educational app designed for children and adults to assists them in the learning of elementary mathematics. By downloading, accessing, or using the App, you (if you are over 18) or you (if you are under 18) and/or your Parent/Guardian, and/or adult representative and/or entity including schools, colleges and businesses (the "user", “you”, “your”), agree to comply with and be bound by these Terms and Conditions. Please review these Terms and Conditions carefully before using the App. 

If you do not agree to these Terms, you should not use the App or any product or service provided by Tekemu Limited.

“Service” refers to any service provided by or through the App, Tekemu.com (website) or by or through Tekemu Limited.

     2. Acceptance of Terms

By downloading and or using the App or any App or Service provide by Tekemu Limited, you agree to abide by these Terms and any future amendments. These Terms may be updated, changed or amended from time to time. It is your responsibility to check for updates. Continued use of the App following the posting of any changes to these Terms will constitute acceptance of such changes.

All Users must agree to our Privacy Policy. By using the App or any App or Service provided by Tekemu Limited, you agree and consent to us using your data in accordance with the Privacy Policy.

If you access or download our App or access or use our Services through a third-party platform, site or provider, you may be required to comply with their policies in addition to these Terms.

We do not accept responsibility for any interference or damage to your computer, computer system, mobile device, tablet or any other device which has resulted through use or access to the App or Service.

     3. Eligibility

     3.1 Age Requirement

The App is intended for all ages, with a focus on children under the age of 13. The App must be used under the supervision of a parent or guardian (over 18 years old) who has agreed to these Terms on behalf of their child. You must be a parent or legal guardian (over 18 years old) to create an account and accept these Terms. You are responsible for the acts of any user under the age of 18 that you have given App access to.

If you are under the age of 18 you agree that you have received permission from a Parent or Legal guardian to use the App or Service. If you have not, you are prohibited from using the App or Service.

     3.2 Parental Consent

By allowing your child to use the App, you agree that you provide consent for your child’s use and that you understand and accept the App’s features, including any collection of data as described in the Privacy Policy.

     3.3 System Requirements.

It is the user’s responsibility to ensure the device and the operating system used for the App meets the minimum requirements. 

     4. User Responsibilities

     4.1 Account Creation

To use certain features of the App, you will need to create an account. You are responsible for all activity that occurs under your account including any harm or damage to us or anyone either by you or someone using your account. 

You must provide accurate and current information including a valid email address when registering and update it as necessary. You may not share your account login credentials with anyone else. As such, you may not transfer, sell, gift or give away your account to someone else.

You must notify us immediately if you are aware of some else using your account. We advise changing login details/password to prevent any damage. To the fullest extent permitted under any applicable law we will not take responsibility for losses or harm you may suffer because of an unauthorised person accessing your account and/or using your login credentials.

In the event of direct contact with Tekemu Limited, additional information may be required to confirm who you are.

You agree not to attempt to gain unauthorised access to, circumvent, modify, disrupt, damage, overburden the App, Apps data, User data or any Service or related device, system or network.

You agree to be responsible for your account and account password and take actions to keep this confidential. 

Account password must be unique, i.e. not used on any other/third party application, service, website etc.

You are responsible for any updates to the App or third-party software/operating system that is required to run the App.

     4.2 Supervision

Parents or legal guardians are responsible for monitoring and supervising their child’s activity on the App. The App contains educational content suitable for children, but it is the parent’s responsibility to ensure it is appropriate for their child.

     5. Prohibited Conduct and Actions

You agree not to:

- Use the App or Service for any unlawful purpose or in violation of any applicable laws or regulations.

- Upload, post, or share any content that is harmful, offensive, or inappropriate to other users or to Tekemu Limited, the App or Service.

- Attempt to hack, disrupt, or interfere with the App’s functionality, data or security.

- Attempt to hack, disrupt, or interfere with a Services functionality, data or security.

- Provide false information when creating an account or during use of the App.

- Engage in acts or attempts to abuse, threaten, harm, harass or advocate or incite and/or violence towards another user, person, group, employee of Tekemu Limited.

- Use the App or Service in any manner that may infringe any copyright, material, trademark, patent, right or privacy.

- Access or attempt to access or solicit the data or personal information of other users or employees of Tekemu Limited.

- Access or attempt to access, copy or reproduce, translate, reverse engineer, derive source code from, modify, disassemble, decompile, or create derivative works based on or related to the App or Services.

- Use, create, promote, advertise, make available and/or distribute any cheats, bots, hacks, modifications or software that can be used to modify, damage or delete the App or Service data including user data within the App or Service or App or Service data that is held on the device or system the App/Service is stored/accessed from.

     6. Privacy Policy

The App takes your privacy seriously. Our Privacy Policy outlines how we collect, use, and protect personal information. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

     7. Content and Intellectual Property

     7.1 Ownership

All content available in the App or Service or by Tekemu Limited, including but not limited to names, logos, text, graphics, images, characters, concepts, effects, audio, video, recordings of games and game play, educational activities and software, is the property of Tekemu Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Users must not in any form whether physical, digital or other form:

re-sale, reproduce, distribute, adapt, print, publish or create imitation works or use for commercial purposes any part of the App or Service.

use of any content from the App or Service for any commercial or non-commercial use (other than the intended use of the App or Service) is not permitted.

     7.2 User-Generated Content

If the App or Service allows users to create or upload content (such as drawings, responses, or other materials), you grant the App a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute such content for purposes related to the operation of the App. You represent that you have all necessary rights to any content you provide and that such content does not violate any third-party rights.

     8.Subscription and Payment

     8.1 Subscriptions

The App offers paid features, such as subscriptions or in-app purchases, the following terms apply:

- Payment is required for access to certain features of the App. Prices are subject to change without notice.

- Subscriptions will automatically renew unless cancelled at least 24 hours before the renewal date or in accordance with the Terms and Conditions as set out by the Third Party the App was subscribed through or payment was made to. 

- Refunds are provided in accordance with applicable laws and the Terms and Conditions of the third-party subscriber.

- Subscriptions to the App or not transferable.

- We reserve the right to change our subscription upon renewal. 

We reserve the right to cancel and/or suspend unpaid subscriptions or accounts linked to unpaid subscriptions.

- We reserve the right to charge for additional services provided by us.

- Discounts or special offers are solely at our discretion.

- Your account may be deleted or suspended without refund if you misuse the App and/or Service.

     9. Data usage

Use of the App will require internet usage and may incur charges. These charges and/or any charges incurred in the use of the App or Service are the responsibility of the User.

     10. Third-Party Links

The App may contain links to third-party websites or services that are not owned or controlled by Tekemu Limited. We are not responsible for the content, privacy policies, or practices of third-party websites. We encourage parents or adult users to review these sites and services before allowing children to use them.

     11. Disclaimer of Warranties

Every effort is made to ensure the accuracy of content within The App and Services provided by us, however we do not warrant the accuracy, adequacy, completeness of the App or Service and its content. 

The App and/or Services is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied including timeliness, accuracy, completeness. Tekemu Limited does not guarantee or warrant that the App or Service will be error-free, uninterrupted, updated, secure, suitability for your education needs, error free, virus free, accurate, complete, without harmful content or without harmful function.

We do not accept responsibility for any loss suffered because of your reliance on the intended purpose, accuracy or content of the App or Service.

     12. Limitation of Liability

To the maximum extent permitted by law, Tekemu Limited and its Directors, affiliates, officers, employees, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages, injury, loss of profit, corruption or loss of data arising from your use of the App or Service, including but not limited to data loss, unauthorized access, or third-party actions, content or omission of content.

     13. Indemnification

You agree to indemnify Tekemu Limited, our staff, agents, contractors, directors and hold Tekemu Limited and those aforementioned, harmless from any claims, damages, losses, actions, proceedings, costs or expenses (including legal fees) arising out of your violation of these Terms, use or misuse of the App or Service, or breach of any third-party rights.

     14. Termination

We reserve the right to modify, terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

We reserve the right to stop offering the App or Service, partly or in full, at any time, for any reason, or if demand is considered to be insufficient, consistent with applicable law. If this occurs you may lose access to the App or Service, in part or in full. 

We reserve the right to delete any account and related data should it be inactive for an extended period of time.

Unless required by applicable law we are not required to notify you in advance of modification, termination or suspension of account, or to provide refunds or compensation in either financial, or a material or non-material benefit.

You may choose to close or delete your account for any reason at anytime. By doing so, you may no longer have access to the App or Service, in part or in full, or be able to retrieve any data related to the App. Account deletion can be done by sending us an email support@tekemu.com. 

It is your responsibility to ensure any subscriptions made through the App stores, or through any third party is terminated. 

Any refunds are subject to the Terms and Conditions of the App store through which the App or Service was subscribed through. 

     15. Governing Law

These Terms shall be governed by and construed in accordance with the English law, without regard to its conflict of law provisions. The courts of England shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection to these Terms.

If any terms or condition set out in these Terms is held to be unenforceable, invalid or illegal for any reason, the remaining terms and conditions remain enforceable and valid.
